These Terms govern your use of OraWhale. By creating an account, starting a trial, purchasing a subscription, or continuing to use OraWhale, you agree to these Terms and the Privacy Policy.

1. Eligibility and initial availability

You must be at least 18 years old and a resident of one of the 50 U.S. states or the District of Columbia to create an OraWhale account during the initial launch. Public pages may remain visible elsewhere, and existing users may be able to sign in while traveling.

You agree to provide accurate eligibility and billing information and not to use location-masking or false information to circumvent regional availability.

2. OraWhale’s purpose

OraWhale is a reflective oracle and journaling service for personal reflection and entertainment. It does not predict the future or provide medical, mental-health, therapeutic, legal, financial, religious, crisis, or other professional advice.

3. Accounts

You are responsible for access to your email account, devices, browser storage, and any journal passcode you set. Notify OraWhale if you believe your account has been used without authorization.

4. Privacy and journal content

You retain responsibility for the content you enter. You grant OraWhale the limited permission needed to store, process, sync, display, search, summarize, and otherwise provide features you request. Do not enter content you are not permitted to store.

5. Plans and feature limits

OraWhale may offer Wanderer, Seeker, Oracle, trials, and other plans. Features, storage, limits, pricing, and availability may change prospectively. Current plan details are shown in the service and at Stripe Checkout.

6. Free trials

Unless stated otherwise, trial eligibility is limited to one free trial per OraWhale account across paid plans. If you do not cancel before the trial ends, Stripe may charge the payment method you provided for the selected plan and billing interval. The checkout confirmation shows the trial length, first charge timing, and renewal terms.

7. Subscriptions and automatic renewal

Paid subscriptions renew automatically until canceled. Prices are shown in U.S. dollars, and applicable tax may be added at checkout. Stripe processes payments. You authorize Stripe to charge the applicable recurring amount according to the schedule shown at checkout.

8. Cancellation

Cancel through Account → Subscription → Manage Billing. Cancellation stops future renewal but normally does not refund a completed charge. Access may continue until the end of the paid period. Account deletion does not automatically cancel billing.

9. Refunds

Refunds are governed by the Refunds & Cancellation Policy and applicable law. Nothing in these Terms limits rights that cannot legally be waived.

10. Plan changes

Upgrades, downgrades, and billing-interval changes may affect trial status, timing, charges, credits, and access. Review Stripe’s confirmation before approving a change.

11. Acceptable use

Do not misuse OraWhale, interfere with security or availability, access another person’s account or data, scrape or reverse engineer protected parts of the service except where law permits, upload unlawful content, or use the service to harm others.

12. Intellectual property

OraWhale’s software, branding, card text, artwork, design, databases, and other service content are owned by OraWhale or its licensors and are protected by applicable law. Your private journal content remains yours, subject to the limited service permission described above.

13. Third-party services

OraWhale relies on providers such as Stripe, Supabase, Cloudflare, Resend, Google, and others. Their services and terms may affect particular features. OraWhale is not responsible for outages or acts outside its reasonable control.

14. Service changes and availability

We may update, suspend, discontinue, or change features. We do not guarantee uninterrupted availability or that locally stored data will survive browser clearing, private browsing, device loss, or changes of browser or device.

15. Disclaimers

OraWhale is provided “as is” and “as available” to the extent permitted by law. Symbolic readings are subjective and should not be relied on for important professional, health, safety, financial, or legal decisions.

16. Limitation of liability

To the maximum extent permitted by law, OraWhale LLC and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities. Mandatory rights and remedies under applicable law remain unaffected.

17. Indemnity

To the extent permitted by law, you agree to be responsible for claims arising from your unlawful misuse of OraWhale or violation of these Terms.

18. Termination

We may suspend or terminate access for material violations, fraud, abuse, security risk, or legal requirements. You may stop using OraWhale at any time, but you must separately cancel any active subscription.

19. Changes to these Terms

We may update these Terms. We will update the date above and provide additional notice when appropriate. Changes apply prospectively unless law requires otherwise.

20. Governing law

These Terms are governed by New Jersey law, without limiting mandatory rights under the law of your U.S. state. Where permitted, disputes will be handled in state or federal courts located in New Jersey.
